So how long each individual family has to file a claim varies. Each state has what’s called a statute of limitations, which is the amount of time you have to file. The most common is two years, but it’s not straightforward. If you think you have a claim, call us and let us talk about the statute of limitations because what is sort of unique in these cases is that even within state statute limitations, many states have exceptions. There are instances, for example, where a company engaged in fraud or fraudulent concealment, or instances where you couldn’t have discovered the cause of the harm, along with other factors.

The short answer is don’t wait, because in general you’re looking at one to three years depending on the state you’re in under the traditional concepts of statute of limitations. But these are also very different cases. These companies have been lying to the public for years. They are still to this day testifying under oath that they are not designing their products to be addictive, when their own publicly available documents now show otherwise. So there are defenses available to them arguing that you’re out of time.
